These Terms of Service ("Terms") govern your access to and use of the Sweetstoy website at https://sweetstoy.com (the "Site"), including any purchases, services, features, content, and communications made available through the Site.

The Site is operated by Hong Kong Yuchen Digital Technology Co., Limited, doing business as Sweetstoy ("Sweetstoy," "we," "us," or "our").

By accessing the Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms and the policies incorporated into them. If you do not agree, you must not use the Site or place an order.

1. Eligibility and Age Requirement

The Site sells products intended only for adults. You must be at least 18 years old and have reached the legal age of majority in the jurisdiction where you reside to access the Site or purchase our products.

By using the Site, you confirm that:

  • You meet the applicable legal age requirement;
  • You have the legal capacity to enter into a binding contract;
  • Your access to the Site and purchase, import, possession, and use of the products are lawful in your jurisdiction; and
  • You are not purchasing products for or on behalf of a minor.

We reserve the right to refuse or cancel an order when we reasonably believe that the age requirement has not been met or that completing the order would violate applicable law.

2. Account Information

You may be able to browse or place an order without creating an account. If you create an account, you must provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. You must notify us promptly at info@sweetstoy.com if you believe that your account has been accessed without authorization.

We may suspend or restrict an account where reasonably necessary to investigate suspected fraud, unlawful activity, abuse, or a security incident.

3. Product Information

We make reasonable efforts to describe and display our products accurately. However, product colors and appearance may vary depending on your screen, lighting, device settings, manufacturing batches, or other factors outside our reasonable control.

Product dimensions, weights, colors, materials, features, packaging, and specifications may be subject to minor variations. Such variations do not affect your statutory rights where a product is materially different from its description, defective, unsafe, or otherwise not in conformity with applicable law.

Images are provided for illustration. Unless expressly stated otherwise, accessories, decorations, or other items shown in an image are not included.

We may update product descriptions, availability, specifications, and prices. Changes will not retroactively affect an order that we have already accepted unless required by law or agreed with you.

4. Product Safety and Intended Use

You must read and follow all instructions, warnings, cleaning directions, storage requirements, and safety information supplied with a product.

Products must be used only for their intended purpose. Stop using a product immediately if it causes pain, injury, irritation, numbness, allergic reaction, overheating, damage, or other unexpected effects.

Information provided on the Site is for general product and educational purposes only. It is not medical advice and is not a substitute for advice from a qualified healthcare professional. If you have a medical condition, are pregnant, have recently undergone surgery, use an implanted medical device, or have concerns about whether a product is suitable for you, consult a qualified healthcare professional before use.

Nothing in this section excludes or limits any liability or remedy that cannot lawfully be excluded, including applicable product safety or product liability rights.

5. Orders and Contract Formation

Products displayed on the Site constitute an invitation to place an order and do not guarantee availability.

After you submit an order, we may send an automatic order confirmation. This confirmation acknowledges receipt of your order but does not necessarily mean that the order has been accepted.

An order is accepted when we confirm acceptance or dispatch the products, whichever occurs first. Products within the same order may be accepted and dispatched separately.

We may refuse or cancel an order before dispatch where reasonably necessary, including when:

  • A product is unavailable;
  • There is an obvious pricing or product-description error;
  • Payment cannot be authorized;
  • The order is identified as potentially fraudulent or abusive;
  • Quantity limits have been exceeded;
  • The delivery address is incomplete or unsupported; or
  • Completing the order would violate applicable law or shipping restrictions.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method. We will not substitute a materially different product without your agreement.

6. Prices, Currency, Taxes, and Charges

Prices are displayed in the currency shown on the Site or at checkout. The final amount payable will be displayed before you submit the order.

Prices and promotions may change from time to time. A change will not affect an order already accepted by us unless the displayed price was an obvious error that you knew or reasonably should have recognized.

Applicable taxes, shipping charges, discounts, and other charges will be displayed at checkout where required and reasonably determinable.

Your bank, card issuer, or payment provider may charge foreign-exchange, cross-border, or other processing fees. These third-party charges are not controlled by Sweetstoy.

Import duties, customs charges, and local taxes may apply depending on the destination and the checkout arrangement. Where they are not collected at checkout, the recipient may be required to pay them, subject to applicable law. Please review the information displayed at checkout before completing your order.

7. Payment

Payment must be made using a payment method offered at checkout. By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize the applicable payment provider to process the transaction.

Payments may be processed by Shopify or other third-party payment providers. Their services may be governed by separate terms and privacy notices.

We may delay dispatch while a payment, address, identity, fraud-prevention, or security review is being completed. We will not knowingly collect payment for an order that we do not intend or are unable to fulfill.

8. Promotions and Discount Codes

Promotions and discount codes are subject to any specific conditions stated with the offer, including validity periods, eligible products, customer limits, and minimum order values.

Unless expressly stated otherwise:

  • Only one discount code may be used per order;
  • Discounts cannot be exchanged for cash;
  • Discounts cannot be applied retroactively to completed orders; and
  • Discounts may not apply to shipping, taxes, gift cards, or excluded products.

We may cancel a promotion or reject a discount code where it has expired, was obtained unlawfully, is used contrary to its stated conditions, or is affected by an obvious technical error. This does not affect orders already accepted unless permitted by applicable law.

9. Shipping and Delivery

Our complete shipping terms are available in the Shipping Policy, which forms part of these Terms.

Sweetstoy currently supports delivery to selected destinations, including:

Austria, Australia, Belgium, Canada, Switzerland, Czechia, Germany, Denmark, Spain, Finland, France, the United Kingdom, Hong Kong SAR, Ireland, Israel, Italy, Japan, South Korea, Malaysia, the Netherlands, New Zealand, Poland, Portugal, Sweden, Singapore, and the United States.

Availability may also depend on the product, delivery address, carrier coverage, and restrictions displayed at checkout.

Unless a different condition is shown at checkout, orders of USD 59.99 or more qualify for free shipping.

In-stock orders placed on weekdays are normally processed within 24 to 48 hours. Orders placed during weekends are normally processed beginning on Monday. Out-of-stock, back-order, or pre-sale items may require at least one additional week or the period stated on the product page.

After dispatch, delivery usually takes approximately 3 to 15 days, depending on the destination, carrier, customs procedures, weather, peak periods, and other circumstances.

Processing and delivery times are estimates unless we expressly agree to a guaranteed delivery date. We will notify you when we become aware of a material delay.

You are responsible for providing a complete and accurate delivery address. If an order is returned, delayed, or lost because the address supplied was incorrect or incomplete, additional shipping charges may apply to the extent permitted by law.

Risk of loss and legal title transfer according to the rules applicable to the transaction and destination. Nothing in these Terms transfers risk earlier than permitted by mandatory consumer law.

10. Inspection, Returns, and Refunds

Our complete return and refund rules are available in the Refund Policy, which forms part of these Terms.

You should inspect your order promptly after delivery. If an item is missing, damaged, defective, incorrect, or materially different from its description, contact us at info@sweetstoy.com and include your order number and appropriate supporting information.

Subject to the Refund Policy and applicable law:

  • Eligible unopened and unused products with intact packaging, seals, and labels may be requested for return within 30 days;
  • Defective-product claims should be submitted within 90 days after delivery;
  • Returns must be sent by mail using the instructions provided by our support team;
  • Customers are generally responsible for return shipping for non-defective returns;
  • Confirmed defective products may be replaced with the same product or a comparable product of similar value; and
  • Return receipt and processing may take up to 3 to 4 weeks, followed by approximately 3 to 7 business days for the payment provider or bank to post an approved refund.

For hygiene and safety reasons, opened, used, or unsealed intimate products may not be eligible for a change-of-mind return unless they are defective, incorrect, damaged, or must be accepted under applicable law.

Nothing in these Terms or the Refund Policy limits any mandatory cancellation, conformity, warranty, refund, repair, replacement, or other consumer rights available to you under applicable law.

11. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy.

By placing an order, you agree that we may send you transactional communications reasonably necessary to process and service the order, including order confirmations, payment notifications, shipping updates, recall or safety notices, and customer-service messages.

Marketing communications will be sent only as permitted by applicable law. You may unsubscribe from marketing emails using the unsubscribe link provided in the message. Unsubscribing from marketing does not prevent us from sending necessary transactional or legal communications.

12. Acceptable Use

You must not use the Site or our services to:

  • Violate any applicable law or the rights of another person;
  • Purchase products for a minor or facilitate access by a minor;
  • Provide false, misleading, fraudulent, or incomplete information;
  • Impersonate another person or use a payment method without authorization;
  • Introduce malware, malicious code, or harmful technology;
  • Attempt to bypass security, access controls, purchase limits, or fraud-prevention systems;
  • Scrape, crawl, copy, or extract Site content through automated means in a manner that disrupts the Site or violates applicable law;
  • Interfere with the operation, availability, or security of the Site;
  • Use the Site to transmit abusive, defamatory, obscene, infringing, or unlawful material; or
  • Resell products in violation of applicable law, product restrictions, or an expressly stated resale restriction.

We may take proportionate action, including restricting access or cancelling affected orders, where we reasonably believe this section has been violated.

13. Intellectual Property

The Site and its content, including text, product descriptions, graphics, photographs, videos, branding, logos, page designs, software, and other materials, are owned by or licensed to Sweetstoy and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for lawful personal shopping purposes.

You may not reproduce, distribute, modify, sell, license, publish, commercially exploit, reverse engineer, or create derivative works from the Site or its content without prior written permission, except where such restriction is prohibited by law.

All third-party trademarks and content remain the property of their respective owners.

14. Reviews and User-Submitted Content

If you submit a review, photograph, comment, suggestion, or other content, you confirm that:

  • You created the content or have permission to submit it;
  • The content is accurate and reflects your genuine experience where presented as a review;
  • The content does not infringe another person's rights;
  • The content does not contain confidential personal information; and
  • The content is not unlawful, fraudulent, threatening, abusive, or misleading.

You retain ownership of your content. You grant Sweetstoy a non-exclusive, worldwide, royalty-free license to host, reproduce, format, translate, display, and use the content for operating, improving, and promoting the Site and our products, subject to applicable privacy and consumer-protection laws.

We may moderate or remove content where reasonably necessary to comply with law, protect rights, prevent fraud or abuse, or enforce these Terms. We will not knowingly alter a genuine review in a way that materially misrepresents the reviewer's opinion.

15. Third-Party Services and Links

The Site may include links to or integrations with third-party services, including payment providers, shipping carriers, analytics services, and other websites.

Third-party services may be governed by their own terms and privacy policies. Sweetstoy does not control independent third-party websites and is not responsible for their content or practices, except to the extent liability cannot be excluded under applicable law.

A link or integration does not necessarily constitute our endorsement of every product, statement, or service offered by the third party.

16. Service Availability

We aim to keep the Site available and accurate, but we do not guarantee that it will always be uninterrupted, error-free, or free from technical issues.

We may temporarily suspend or restrict parts of the Site for maintenance, security, legal compliance, updates, or circumstances outside our reasonable control. Where reasonably practical, we will try to minimize disruption.

We may correct typographical, technical, pricing, inventory, or product-information errors. Corrections will be handled fairly and will not limit your mandatory consumer rights.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site is provided on an "as available" basis. We do not guarantee that every feature will always be available or that the Site will meet every individual requirement.

Products remain subject to all warranties, conformity requirements, safety obligations, and consumer guarantees that apply by law. Nothing in these Terms excludes an express written warranty provided with a product or a legal warranty that cannot be excluded.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence where such liability cannot be excluded;
  • Fraud or fraudulent misrepresentation;
  • Willful misconduct or gross negligence where applicable;
  • Defective or unsafe products where liability cannot be excluded;
  • Breach of mandatory consumer rights; or
  • Any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above, Sweetstoy is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.

We are not responsible for losses caused solely by your unlawful use, misuse contrary to supplied instructions, unauthorized product modification, inaccurate delivery information, or failure to take reasonable steps to reduce avoidable loss.

If you use the Site primarily for business purposes, we are not responsible, to the extent permitted by law, for loss of profit, revenue, business opportunity, goodwill, anticipated savings, or business interruption.

This section is intended to allocate responsibility only to the extent permitted by law and does not reduce any remedy available under mandatory consumer-protection law.

19. Events Outside Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, epidemic or pandemic conditions, war, civil disturbance, government action, customs delays, carrier disruption, labor disputes, utility failures, cyberattacks, or interruption of transportation or communication networks.

This section does not remove any right you may have to cancel an order or receive a refund where performance becomes impossible or excessively delayed under applicable law.

20. Suspension and Termination

You may stop using the Site at any time.

We may suspend or terminate access where reasonably necessary because of serious or repeated violations of these Terms, fraud, security risks, unlawful activity, or legal requirements.

Termination does not affect rights or obligations that arose before termination, including payment obligations, accepted orders, intellectual-property rights, or provisions that by their nature should survive termination.

21. Changes to These Terms

We may update these Terms to reflect changes to our services, business practices, technology, or legal obligations.

The updated version will be published on this page with a revised effective date. Material changes will apply prospectively and will not retroactively alter the terms governing an order already accepted, unless required by law or agreed with you.

Your continued use of the Site after an updated version becomes effective constitutes acceptance of the updated Terms for future use and future orders.

22. Governing Law and Dispute Resolution

These Terms and any non-contractual obligations arising from them are governed by the laws of the Hong Kong Special Administrative Region.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections available under the laws of the country or region where you habitually reside.

Before starting formal proceedings, we encourage you to contact us at info@sweetstoy.com so that we can try to resolve the matter.

Subject to any mandatory right you have to bring a claim in another court or forum, the courts of the Hong Kong Special Administrative Region will have non-exclusive jurisdiction over disputes arising from or connected with these Terms.

23. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed to the minimum extent necessary. The remaining provisions will continue in effect.

24. No Waiver

If we delay or fail to enforce a provision of these Terms, that does not waive our right to enforce it later. A waiver is effective only if it is expressly made in writing.

25. Assignment

You may not transfer your contractual rights or obligations without our prior written consent, except where applicable law permits such a transfer.

We may transfer our rights or obligations as part of a merger, reorganization, sale of business, or transfer to an affiliated company, provided that the transfer does not reduce your rights under an accepted order or mandatory consumer law.

26. Entire Agreement

These Terms, together with the policies and information expressly incorporated into them, constitute the agreement between you and Sweetstoy concerning your use of the Site and purchases made through it.

If a product page, promotion, or written offer contains specific terms, those specific terms apply to that product or offer. If there is a conflict, mandatory law takes priority, followed by the specific written terms and then these general Terms.
